Terms of service.

The agreement between you and MyCultBox — what you can expect from us, and what we ask of you.

These Terms of Service ("Terms") are an agreement between you and Jan Hogewoning ("MyCultBox", "we", "us"), the operator of the MyCultBox service at www.mycultbox.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

The Service is operated by Jan Hogewoning, a sole trader registered with the Belgian Crossroads Bank for Enterprises (KBO/BCE) under enterprise number 1028.233.850, VAT number BE 1028.233.850, with a registered address at Guldensporenlei 8, 2300 Turnhout, Belgium. 2. The Service

MyCultBox is a personal cultural diary that lets you record and organise the books, music, films and live events you experience — adding metadata, reviews, ratings, images and notes. We may add, change or remove features over time to improve the Service.

3. Eligibility and your account

  • You must be at least 16 years old to use the Service.
  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • You agree to provide accurate information and to keep it up to date.
  • You may sign in using a third-party provider (such as Google or Apple); their own terms also apply to that sign-in.

4. Plans, payment and renewals

  • MyCultBox offers a free plan and a paid "Pro" plan. Current prices and plan limits are shown on our pricing page.
  • Paid subscriptions are billed in advance on a recurring basis (monthly or yearly) and renew automatically until cancelled. Payments are processed by our payment provider, Stripe; we do not store your full card details.
  • Prices are shown inclusive or exclusive of VAT as indicated at checkout. We may change prices on a going-forward basis; we will give you reasonable notice before a change affects your renewal.
  • As an EU consumer you may have a statutory right of withdrawal. Because the Service is delivered immediately as a digital service, by starting a paid subscription you ask us to begin performance during the withdrawal period and acknowledge you may lose that right once performance has begun, except as required by law. Statutory consumer rights are not affected.

5. Cancellation

You can cancel your paid subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you keep access to Pro features until then. We do not provide pro-rated refunds for partial periods except where required by law.

6. Your content

  • You keep all rights in the reviews, notes, images and other content you add ("Your Content"). We do not claim ownership of it.
  • You grant us a limited licence to store, process and display Your Content solely to operate and provide the Service to you (for example, creating image thumbnails or generating AI descriptions you request).
  • You are responsible for Your Content and confirm you have the rights to upload it, including any images.
  • You can export your data at any time and delete Your Content or your account, as described in our Privacy Policy.

7. Acceptable use

You agree not to:

  • break the law or infringe anyone's rights using the Service;
  • upload malicious code, or attempt to disrupt, overload, scrape or gain unauthorised access to the Service or its systems;
  • resell or commercially exploit the Service without our permission; or
  • misuse automated metadata and AI features to place excessive load on the Service or on the third-party sources it relies on.

8. Third-party metadata and links

The Service enriches your entries with information from third-party sources (such as ISBNDB, Open Library, Google Books, Apple, Spotify, Discogs, The Movie Database (TMDB) and Setlist.fm). That content belongs to its respective owners, is provided "as is", and may be inaccurate or unavailable. We are not responsible for third-party content or websites and do not endorse them. This product uses the TMDB API but is not endorsed or certified by TMDB.

9. Our intellectual property

The Service itself — including its software, design, logos and text (other than Your Content and third-party content) — belongs to us or our licensors and is protected by intellectual-property laws. These Terms do not grant you any rights in it beyond using the Service as intended.

10. Availability and warranties

We work hard to keep the Service available and reliable, but we provide it "as is" and "as available" and do not guarantee that it will be uninterrupted, error-free, or that metadata or AI-generated content will be accurate. This does not exclude any warranties that cannot be excluded under applicable law, including mandatory EU consumer law.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of data that you could have prevented by keeping your own export/backup. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by our negligence, fraud, or your mandatory statutory consumer rights).

12. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or use the Service unlawfully, giving notice where reasonable. On termination, the licences you grant us end, and we will delete or anonymise your data as set out in the Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you (for example by email or in-app) before they take effect. Continuing to use the Service after a change means you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of Belgium, without affecting any mandatory consumer-protection rights you have in your country of residence. Disputes will be subject to the competent courts of Belgium, again without affecting your mandatory rights. EU consumers can also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
